  • Nursing home staffing floor. A Florida nursing home must provide a weekly average of 3.6 hours of direct care per resident per day, including at least 2.0 CNA hours (never fewer than one CNA per 20 residents) and 1.0 licensed-nurse hour (never fewer than one licensed nurse per 40 residents). Paid feeding assistants count toward the 3.6-hour total, not toward the CNA or nurse minimums. Florida Statutes § 400.23(3)(b)1 and (3)(c), as amended by HB 1239 (2022)
  • When assisted living needs a nurse. An assisted living facility must hold a limited nursing services or extended congregate care license before it offers those services, and must employ or contract with a nurse to provide them, with a nursing assessment of each such resident at least monthly. Florida Administrative Code 59A-36.021 and 59A-36.022; Florida Statutes §§ 429.07, 429.255
  • Home health director of nursing. A home health agency that provides skilled nursing care must have a director of nursing and may not operate more than 30 calendar days without one. AHCA must be notified within 10 business days when a director of nursing leaves and again when one is hired. Florida Statutes § 400.476(2)
